The Hon’ble JUSTICE PARTHA SARATHI CHATTERJEE Date : 24th September, 2026 Appearance : Mr. Dipak Kumar Gupta, Adv. Ms. Anwesha Basu, Adv. ... for the petitioner. The Court : This is an application for grant of probate in respect of the last Will and Testament of Subrata Datta Gupta (since deceased). Mr. Dipak Kumar Gupta, learned Advocate representing the petitioner submits that citations have been completed even Summons were issued. However, despite receipt of Summons, no legal heirs of the testator have come up to file caveat and/or written objection. He prays for grant of probate. He submits that ad valorem Court fees have already been paid. Heard learned Advocate representing the petitioner and upon perusal of the materials on record including the copy of the Will. Record reveals that in the petition it was mentioned that the writing annexed to the petition is the last Will and Testament of the testator. He mentioned the death of the testator and the testator had permanent place of abode within the territorial jurisdiction of this Court. The petitioner has mentioned the value of the estate as disclosed in the affidavit of assets which is
2 likely to come at the hand of the petitioner in the event the probate is granted in respect of the Will. In the affidavit of attesting witness it was clearly mentioned that the witness saw the testator to put his signature on the Will and the testator also saw the witness to sign the Will and the testator was in a sound and disposing state of mind at the time of execution of the Will. Therefore, the petitioner has complied with all the requirements of Section 276 of the Indian Succession Act, 1925 and the propounder has proved the due execution and attestation of the Will. In view thereof, I find no impediment in accepting the prayer of the petitioner. Accordingly, PLA/160/2025 stands allowed. Let the probate be granted with the Will annexed thereto.
