The Court:
1. The alleged contemnor no.2 has filed an affidavit of compliance. The applicants/petitioners are partners of M/s. Bilimoria Brothers. It has been stated by the alleged contemnor that all the partners of the said partnership firm are joint signatories and the order of the Court and the Learned Arbitrator shall be complied with.
2. In paragraph No.6 of the said compliance report, in respect of both the accounts maintained by the partnership firm with the HDFC Bank, it has been specifically mentioned that any one of the signatories could
2 operate the accounts. The names of the petitioners/applicants appear in the list.
3. The bank undertakes to allow the applicants/petitioners to operate the accounts in terms of the order of the learned Arbitrator.
4. Nothing further remains to be decided in the contempt application.
5. Under such circumstances, on the basis of the affidavit of compliance, the contempt application is disposed of.
6. Contempt proceedings are dropped as the bank has categorically mentioned that the petitioners/applicants can operate the bank accounts and sign cheques.
