... For the State. Learned senior advocate appearing for the petitioner submits that petitioner was arrested on 01.06.2026 and since then he is in custody. The incident has trappings of sudden provocation and there are no criminal antecedents of the present petitioner; further prosecution has relied upon 18 witnesses in order to prove its case and till date, witness action has not commenced. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are overt acts attributed to the present petitioner and it is because of the act of the present petitioner, there was untimely death of the deceased. Report submitted by the Inspector-in-Charge, Raniganj Police Station reflects that there are no criminal antecedents of the present petitioner. 2 I have taken into account the materials appearing in the case diary which attributes to the overt acts of the present petitioner. However, the incident seems to have happened in a funeral ceremony and there are trappings of suddenness in the incident happening. In view of the manner and circumstances under which the alleged offence has been complained of in spite of the prosecution case alleging direct complicity of the petitioner, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Parimal Bouri shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Paschim Bardhaman at Asansol. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of the district of Paschim Bardhaman without prior permission of the learned Trial Court.
Additionally, the petitioner shall meet with the Inspector-in-Charge, Raniganj Police Station till the evidence of vulnerable witnesses is completed. Report submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1782 of 2026, is, thus, disposed of. 3 All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
