The petitioner has filed this writ petition seeking following reliefs:- “10.1 That this Hon'ble Court Pleased to Hold that Action on the Part of the Respondent Authorities is in Patent Violation of Article 14, 21 of the Constitution Of India and same is Illegal, Arbitrary, Capricious and Bad in Law & is liable to be set aside. 10.2 That this Hon'ble Court may Kindly be pleased to Quash Impugned Order Dated 25.09.2025 ANNEXURE-P/7_and Impugned Order Dated 25.09.2025 ANNEXURE-P/8 respectively and Respondent May Kindly be Directed to Proceed in Accordance with the Letter and Spirit of the Directives Dated 02.08.2024 of the Rationalization Scheme & Also Directed Respondent No.02 to Decide the Pending Representation of both the Petitioners Preferred on 22.07.2025 (Annexure-P/3). 10.3 That this Hon'ble Court may Kindly be pleased to call the entire record of the case. 10.4 Any Other Relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the Petitioner together with cost of the Petition.” 2. Learned counsel for the Respondents/State submits that according to her instructions, appeal filed by the petitioner before the State Level Committee headed by the Director, Public Instructions is rejected. She placed the copy of the order 17.12.2025 before this Court and also handed it over to the counsel for the petitioner. 3. Learned counsel for the petitioner submits that till today, petitioner was not made aware about the decision of the State Level Committee, however, the copy of the order dated 17.12.2025 is supplied in the Court by the counsel for the Respondents/State. He submits that in view of the submissions made by the counsel for Respondents/State, he may be 3 permitted to withdraw this writ petition at this stage with liberty to file fresh, challenging order of State Level Committee also. 4. In view of the submissions made by learned counsel for the petitioner, this writ petition is dismissed as withdrawn with liberty as prayed for. 5. Certified copy as per rules.
