Accused Nos.2 to 4 in Crime No.281/2026 registered by Mysuru South Police Station, Mysuru District for the offences punishable under Sections 352, 351(2), 115(2), 126(2), 109(1) read with Section 3(5) of BNS, 2023, are before this Court, in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.281/2026 registered by Mysuru South Police Station, Mysuru District against Sri Venugopala and others for the aforesaid offences, based on the first information dated 01.08.2026 received from Smt. Shanthamma, who is the mother of the victim Shivu. Apprehending arrest in the said case, the petitioners had filed - 3 - HC-KAR CNR: KAHC010615162026 NC: 2026:KHC:53081 CRL.P No. 13893 of 2026 Crl.Misc.No.1319/2026 before the jurisdictional Sessions Court, which was rejected on 24.08.2026. Therefore, they are before this Court. 4. A reading of the first information would reveal that the injured victim Shivu and daughter of accused nos.2 to 4 were in love. It is in this background, there was a dispute between two family members. In the alleged incident that had taken place on 31.07.2026, accused no.1, who is the son of accused nos.2 and 4 had allegedly stabbed the injured victim Shivu with a knife causing grievous injury to him. 5. Allegation against accused no.2 is that he had assaulted Shivu with his hands. Accused no.3 is the brother of accused no.2 and he allegedly had caught hold of Shivu and accused no.4, who is the wife of accused no.2 allegedly had held the head of Shivu. There is no allegations against accused nos.2 to 4 about assaulting injured with weapon. 6. The injured had sustained 5 grievous injuries in the incident in question and perusal of wound certificate would reveal that all the said injuries were corresponding to assault - 4 - HC-KAR CNR: KAHC010615162026 NC: 2026:KHC:53081 CRL.P No. 13893 of 2026 made by accused no.1 with a knife. The injured who was admitted in the hospital has been discharged on 10.08.2026 and his condition is said to be stable. Accused no.1 in the present case who was arrested has been granted regular bail by the jurisdictional Sessions Court in Crl.Misc.No.1412/2026 vide order dated 03.09.2026. Major portion of the investigation is already completed. The petitioners have undertaken to cooperate with the police for the purpose of investigation. They do not have criminal antecedents. 7. Under these circumstances, the following : O R D E R The criminal petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.281/2026 registered by Mysuru South Police Station, Mysuru District for the offences punishable under Sections 352, 351(2), 115(2), 126(2), 109(1) read with Section 3(5) of BNS, 2023, subject to the following conditions: - 5 - HC-KAR CNR: KAHC010615162026 NC: 2026:KHC:53081 CRL.P No. 13893 of 2026 a) Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. b) Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) Petitioners shall not tamper with the prosecution witness and they shall co-operate with the police for investigation and appear before them whenever called upon. d) Petitioners shall not involve in similar offences in future.
