(1) Mr.S.Karthikeyan, learned Standing counsel accepts notice on behalf of the respondents 1 and 2. By consent, the main writ petition is taken up for final disposal at the admission stage itself. (2) Since no adverse order is passed against the 3rd respondent, notice to the 3rd respondent is dispensed with. (3) A civil dispute between the petitioner and her brother, who is arrayed as the 3rd respondent, is given a color, violating the right and the writ petition is filed seeking a mandamus, directing the respondents 1 and 2, to consider the representation of the petitioner dated 06.06.2026, in respect of Plot No.93, Door No.27/11, 39th Street, Venkataramana Nagar, Koattur, Chennai-600 050, covered under the Allotment Order dated 07.01.2026. (4) We find that the Allotment Order dated 07.01.2026, which is relied on by the writ petitioner, itself is passed pursuant to the order of this Court https://www.mhc.tn.gov.in/judis WP No. 24527 of 2026 __________ Page3 of 4 dated 05.02.2025, made in WP.No.23488/2024, directing the authorities to consider the petitioner’s representation regarding her request for transferring the Allotment Order in her favour and pass appropriate orders, based on the Sale Deed executed by her father. However, from the affidavit filed in support of the present writ petition and prayer sought for, we find that the brother of the writ petitioner, namely, the 3rd respondent herein, has a rival claim in the property and it appears that he is in occupation of the premises. Though the proceedings dated 26.12.2023 records that during the spot inspection, the plot remained vacant and nobody resides in it, the present affidavit of the writ petitioner states contrary. In any event, we also find that there is a suit pending before the District Munsif Court, Ambattur, in OS.No.33/2023. (5) In such circumstances, the writ petition is not maintainable. The writ petitioner has to work out her remedy before the competent Civil Forum, being a dispute of civil nature between her brother and herself in respect of inheriting the right left by their father late Thiru.K.V.Ragavan. (6) In the result, the writ petition stands dismissed. No costs. (G.J.,J.)
