……for the State. Learned advocate appearing for the petitioner submits that petitioner surrendered on 06.04.2026 and since then he is in custody. The other accused persons are on bail. Petitioner undertakes to abide by each and every condition imposed by this Court. Learned advocate for the State opposes the prayer for bail on grounds of absconsion. 2
I have taken into account the locus of the present petitioner as also the period for which petitioner was not available before the Court. Learned advocate for the defacto complainant opposes the prayer for bail and submits that petitioner inflicted the vital blow. I have taken into account the initiation of the present case which stemmed out because of local dispute. There are no criminal antecedents of the accused persons. There is a probability of suddenness in the incident complained of which escalated including the factum of free fight taking place at the relevant point of time when the incident occurred. Having regard to the overall circumstances of the case and particularly that there are no criminal antecedents of the petitioner, I am inclined to release the petitioner on bail on stringent condition. As such, petitioner, namely Md. Abdur Rouf @ Abdus Rouf @ Tufan be enlarged on bail subject to furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Lalbagh, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and
3 shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Trial Court.
Lastly, petitioner shall henceforth once in a week meet with the Officer-in-Charge of Lalgola Police Station till further orders of this Court. Accordingly, CRM (M) 1853 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
