Mr. Arif Ahmed Ms. Sudipta Bera ….for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Civil Judge (Jr. Div.) at Amta, District-Howrah to dispose of Title Suit No.119 of 2018 expeditiously. From the order sheets appended to this application this Court finds that service upon the defendant nos.3 and 4 is yet to be effected. Thus, the suit is not yet ready for hearing. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. Considering the fact that the suit is pending from the year 2018, the learned Civil Judge (Jr. Div.) at Amta, District-Howrah shall make an endeavour to dispose of Title Suit No.119 of 2018 as expeditiously as possible without granting any unnecessary adjournments to either 2 of the parties after the suit is made ready for hearing in all respect. Accordingly, CO 3339 of 2026 stands disposed of. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
