THIS PETITION COMING ON FOR ADMISSION THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE RAVI V HOSMANI
ORAL ORDER
Seeking for transfer of O.S.no.521 of 2026 on file of VI Additional Civil Judge and JMFC at Hassan to Principal Judge, Family Court at Nelamangala, this petition is filed. 2. Sri.Naveen Kumar G.S, learned counsel appearing for Sri.M.R.Nagabhushana, Advocate for petitioners, submitted that petitioners were defendants no.3 and 5 in O.S.no.521 of 2026, filed by respondents no.1 and 2 herein seeking partition and separate possession. It was submitted that petitioner no.1 was aged more than 60 years, while petitioner no.2, her son, aged 33 years, was suffering from serious renal ailment which required petitioner no.1 to donate one of her kidneys to him. Due to above, both petitioners were not in a fit condition to attend proceedings at Hassan. Therefore, they have sought for transfer of proceedings to Family Court at Nelamangala. 3. To substantiate medical condition of petitioners, discharge summaries, medical bills and photographs are

appended to petition. Learned counsel for petitioners sought to contend that, in view of above facts and circumstances, petition requires to be considered. 4. Heard learned counsel and perused material on record. 5. This petition is for transfer of suit from jurisdictional Court at Hassan to Family Court at Nelamangala. Perusal of suit schedule reveals that all properties mentioned therein are situated at Attavara Village, Hassan District. Defendants no.3 to 7 are stated to be residents of House no. 1289, T.Dasarahalli, Bengaluru and are residing together. Since suit is for partition, defendants no.3 to 7, being relatives and residing together, can co-ordinate and conduct proceedings. Therefore, claim of petitioners that they would find it difficult to defend suit does not appear to be substantiated. Each of defendants need not attend court proceedings on every date of hearing and one of them represent all of them. Further, this Court, in C.P.no.334/2025 [2025:KHC:44927] (Smt.D.Roopa's case), has taken note of possibility of parties appearing before Court through video conferencing by using E-Seva kendra. - 5 -

6. In view of above, I do not find any merit to entertain petition. Petition stands dismissed. However, liberty is reserved to petitioners to seek permission to appear through video conferencing by using facility of E-Seva Kendra. In view of dismissal of petition, I.A.no.1/2026 is also dismissed.
