Mr. Madhu Jana …for DPSC, Howrah. 1. Affidavit-of-service filed on behalf of the petitioners is taken on record. 2. By the present writ petition, the petitioner seeks direction upon the respondent authorities for grant of ‘A’ category scale of pay including the arrear to the petitioner by considering the petitioner as trained teacher upon possessing of Diploma in Elementary Education (in short, ‘D.El.Ed.’) Training Course, 2017-
2019. 3. The petitioner contends that she joined in the post of Assistant Teacher in Podra Board Primary School, under Andul Sankrail Circle, District Howrah on 3rd June, 2024 as an untrained candidate. The petitioner successfully completed D.El.Ed. final examination for the session 2017-2019 from National Institute of Open
Schooling (in short, ‘NIOS’). On 22nd May, 2026 the petitioner made a representation before the authority concerned seeking for grant of ‘A’ category scale of pay. However, the same is pending consideration. Hence, this writ petition. 4. Mr. Santanu Maji, learned advocate for the petitioner submits that the matter be relegated to the appropriate authority to take a decision in respect of the representation of the petitioner dated 22nd May, 2026. 5. Mr. Lokenath Chatterjee, learned advocate representing the State submits that the matter be sent to the appropriate authority for taking a decision. 6. In view of the above submission, the respondent no.2, the Commissioner of School Education, Government of West Bengal is directed to consider the representation of the petitioner dated 22nd May, 2026 and dispose of the same in accordance with law upon notice to the petitioner and pass a reasoned order within a period of six weeks from the date of communication of this order. 7. The reasoned order shall be communicated to the petitioner within a period of one week from the date of passing such order.t
8. Accordingly, the writ petition being WPA 13021 of 2026 stands disposed of. 9. Petitioner is directed to communicate this order to the respondent no.2, Commissioner of School Education, Government of West Bengal, for necessary compliance. 2

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 11. Interim order, if any, stands vacated. 12. All connected applications, if any, stand disposed of. 13. There shall be no order as to costs. 14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 15.
