Report submitted by the State is taken on record. It appears from the report that upon receipt of the application under Section 11 (1)(d) of the West Bengal Panchayat Act, 1973, the Sub-Divisional Officer called for a report from the Block Development Officer in ascertaining the factual position of the issue. On receipt of such report, the Sub-Divisional Officer has formed an opinion with regard to the application under consideration. Learned counsel for the petitioner submits that the Sub-Divisional Officer is hand in gloves with the private respondent and has left no stone unturned to save his position as a member of the Panchayat. Denying such allegation, learned counsel for the private respondent submits that the Sub-Divisional Officer has formed an opinion upon examination of the relevant 2 records and the report submitted by the Block Development Officer. Since the Sub-Divisional Officer has already formed an opinion with regard to the application filed by the petitioner, he is directed to record an order in respect of the said application in terms of Section 11(1)(d) of the Act within two weeks from the date of communication of this order. Since the petitioner appears to be aggrieved by the opinion formed by the Sub-Divisional Officer, which in all probability shall find place in the order to be recorded by him, she is at liberty to take necessary steps in accordance with law. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
