1. The petitioner has filed the present writ application challenging the tender inviting e-tender No. 16 of 2026 dated September 1, 2026 issued by the Department of Youth Services and Sports for supplying food for boarders approximate 70 heads of Bengal Football Academy on operational contract at the premises Vivekananda Stadium, Rahara, Khardah, North 24 Parganas. 2. Learned counsel for the petitioner submits that after the publication of the notice inviting tender a pre-bid meeting was held on September 7, 2026 wherein the petitioner participated in the pre-bid meeting and suggested the price for supplying of food for the boarders of Football Academy. Though the authorities have taken note of the suggestion of the petitioner but the authorities have not taken any decision to the pre--
2 bid meeting. The further contention of the petitioner is that in the year 2022, the authorities have published the same tender wherein the diet chart for supply of food for the Bengal Football Academy was for five times. Now in the present tender, the supply of food is for seven times but the rate in the earlier tender was Rs. 350/- per unit per day and this time also the price is fixed to Rs. 350/- per unit per day. 3. Learned counsel for the petitioner further submits that 4 years before the authorities have issued the supply of food @ Rs. 350/- and now also they are intending for supply of food @ Rs. 350/- per unit per day. Accordingly, the petitioner has made a representation to the authorities on September 15, 2026 but the authorities have neither issued any clarification of the pre-bid meeting nor have taken any decision to the representation submitted by the petitioner. 4. Learned counsel for the respondent authorities submits that the writ petition is not maintainable as the petitioner without participating in the said tender has challenged the tender notice. He further submits that though the authorities have fixed the rate of Rs.
350/- but if the contractors are ready to supply the food for seven times per unit @ Rs. 350/-, the authorities will award the said contract to the said person who is ready and willing to supply, the petitioner cannot challenge the same. 3
5. Heard the learned counsel for the respective parties. Considered the materials on record. 6. This Court finds that the opening date of tender is fixed on September 28, 2026 at 5 pm but the authorities have not taken any decision of the pre-bid meeting and the representation submitted by the petitioner. 7. Considering the above, the respondent No.3 is directed to immediately communicate the decision of the pre-bid meeting dated September 7, 2026 and also to pass a reasoned and speaking order to the representation submitted by the petitioner on or before 12 noon of September 28, 2026 and the same be communicated to the petitioner on or before 1 pm. 8. Accordingly, WPA 27179 of 2026 stands disposed of. 9. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 10. Urgent Photostat certified copy, if applied for, be given to the parties upon compliance with all formalities. (Krishna Rao, J.)
