Mr. Pulakesh Bajpayee, Mr. Subit Majumdar. … for the State. 1. Affidavit of service filed in Court today be kept with the records. 2. The petitioner is aggrieved that his resignation tendered sometime in 2014 has not been considered. 3. The petitioner apprehends that the Rule of minimum service required for resignation, made sometime in 2016, may be applied with retrospective effect to his case, even though the same is not permissible. 4. He has, however, made a representation on August 5, 2026, which is pending consideration. 5. Though the timelines are fairly delayed, there is no dispute to the fact that the resignation has been tendered in 2014. 6. Let the authorities consider the representation of the petitioner dated August 5, 2026 within a period of six 2 weeks from date in line with the decision rendered by this Hon’ble Court in WP.ST 192 of 2016 (Dr. Mousumi Kar vs. The State of West Bengal and others). The resultant order be communicated to the petitioner within a week thereafter. 7. With the afore-stated directions, the writ petition is disposed of. 8. There shall, however, be no order as to costs. 9. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Reetobroto Kumar Mitra, J.)
