JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 06.04.2026 Heard Mr. S Nag, the learned counsel appearing for the petitioner as well as Mr. K Baishya, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 482 of the BNSS, 2023 praying for grant of pre- arrest bail to the petitioner Smt. Rijumoni Das in respect of Dergaon P.S. Case No. 17/2026. 3. Late Mondeep Bora borrowed some money from Sumit Dashad, the husband of the Page No.# 2/2 present petitioner. Sumit Dashad allegedly wanted his money back and therefore, he started to give mental trouble to Mondeep. Ultimately, Mondeep committed suicide by consuming poison. 4. I have considered the submissions made by the learned counsel of both sides. 5. The informant has named the present petitioner in the FIR. But on a plain reading of the FIR, it appears that the present petitioner has nothing to do with whatever happened between her husband and Mondeep. 6. After hearing the learned counsels of both sides, this Court is of the opinion that the petitioner does not deserve to be detained in custody. His pre-arrest bail application is accordingly allowed. 7. It is hereby directed that in the event of arrest in connection with Dergaon P.S. Case No. 17/2026, the petitioner Smt. Rijumoni Das shall be released on bail of ₹25,000/- (Rupees Twenty Five Thousand) with a surety of like amount to the satisfaction of the arresting authority. She shall cooperate with the Investigating Officer as and when called for. With the aforesaid direction, the bail application is disposed of. JUDGE Comparing Assistant
