1. By presenting this writ petition petitioner has prayed for defreezing of his two accounts lying in Bandhan Bank, Boral Branch and Axis Bank, Mahamayatala Branch. It is submitted by learned advocate representing petitioner that bank authorities may be directed to defreeze these two accounts which would permit petitioner to operate said accounts.
2. However, communication dated 14th September, 2026 of Inspector-in-Charge, Narendrapur Police Station reveals different stories. A complaint was lodged by one Ramesh Chowdhury being respondent no.8 alleging Rs. 1,04,06,427.00/- was credited by him to account of petitioner. It further appears that out of aforesaid alleged defrauded sum, Rs. 32,56,677.32/- is
lying in the accounts of petitioner which are debit frozen.
3. If petitioner is permitted to operate said accounts, in that event alleged proceeds of crime can be diverted. Furthermore, petitioner failed to comply with notices under Section 35(3) of BNSS, 2023 in connection with Narendrapur Police Station Case No.746/26 dated 9th June, 2026. Therefore, bona fide of petitioner is questioned. There are allegations against conduct of petitioner giving rise to aforesaid criminal prosecution.
4. Hence, prayer of petitioner for defreezing bank accounts is refused and writ petition is dismissed.
5. However, petitioner is directed to cooperate with investigating officer for taking the investigation to its logical conclusion.
