The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.178/2016 registered at Police Station Nadauti District Karauli for offence under Section 379 IPC praying for grant of bail in a case wherein earlier the petitioners were released on bail, however, they failed to appear before the trial Court on the scheduled dates and their bail bonds were [2026:RJ-JP:13958] (2 of 3) [CRLMB-4968/2026] forfeited on 22.03.2017 and consequently standing arrest warrants were issued against them. 2. Heard learned counsels for the petitioners as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsels for the petitioners submitted that the absence of the accused were neither intentional nor deliberate. They again submits that petitioners are daily wagers and completely dependent on the day to day earning. Therefore, due to earning their livelihood they could not attend the Court on stipulated dates. The accused have now been taken in the custody in pursuance of the standing arrest warrant on 20.02.2026 and 25.02.2026 respectively. Now petitioners undertake to appear on each and every date of hearing in future. Therefore, in the interest of justice the bail applications of the petitioners may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and the explanation furnished by learned counsels for the petitioners but without expressing any opinion on merits/demerits of the case, this Court is of the view that petitioners deserve one more opportunity to face the trial. 6. Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Sultan Singh S/o Shri Parwat Singh and Rajesh S/o Ramchandra, be released on bail, provided they furnish personal bonds in the sum of Rs.50,000/- each with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned [2026:RJ-JP:13958] (3 of 3) [CRLMB-4968/2026] trial court with the stipulation that they shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
