It is submitted by the learned advocates that the parties have settled their dispute outside the Court and the appellant is not willing to proceed with this appeal. Upon settlement being arrived at between the parties, the parties have filed a joint compromise application being CAN 3 of 2026 to dispose of the instant Second Appeal in accordance with terms of compromise. Upon hearing the learned advocates and upon perusing the terms of compromise entered into between the parties on 3rd July, 2026 marked Annexure-C to the application, this Court is of the view that the agreement is lawful and thus application being CAN 3 of 2026 stands allowed. Thus, decree be drawn up in accordance with terms of compromise marked Annexure-C to the application being CAN 3 of 2026. As the appeal stands disposed, the appellant should be permitted to withdraw the security amount of Rs.50,000/- deposited before the Civil Judge (Senior Division), 2nd Court, Paschim Meninipur in Title Execution Case No. 1 of 2016 upon compliance of necessary formalities. Parties have submitted that in accordance with terms of compromise, consideration amount is received and key of the suit property is handed over. (Biswaroop Chowdhury, J.) 2
