The office of the Pradhan of Budhigram Gram Panchayat fell vacant upon removal of the Pradhan on 29th July, 2026. The Prescribed Authority fixed the date of meeting for election of the new Pradhan on 10th August, 2026. The meeting was postponed due to non-availability of police assistance. A further date of meeting was fixed on 27th August, 2026. The said meeting was also postponed on the same ground. The petitioners who are members of the Panchayat seek a direction upon the Prescribed Authority to convene the meeting and conclude the proceeding in accordance with law. In view of the fact that the office of the Pradhan of the Panchayat is lying vacant after removal of the earlier 2 Pradhan therefrom, the Prescribed Authority and Block Development Officer, Rampurhat-II Development Block, being the 5th respondent herein, is directed to convene the meeting for election of the new Pradhan within 10 days from the date of communication of this order upon service of notice to the parties concerned and take the proceeding to its logical conclusion in terms of Rule 6(1) of the West Bengal Panchayat (Constitution) Rules, 1975 including the concurrence of the District Panchayat Election Officer. The Officer in Charge of Tarapith Police Station, being the 6th respondent herein, is directed to render necessary assistance to the Prescribed Authority so that the meeting is held without any hindrance. The police authority shall ensure safe passage of the members of the Panchayat including the petitioners herein to the venue of the meeting so that they are able to cast their votes freely, safely and independently. The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
