Mr. G.C. Joshi, learned A.G.A., for the State of Uttarakhand. 3. The present Criminal Jail Appeal has been preferred through learned Legal Aid Counsel- Ms. Reema Rana. 4. Pursuant to the earlier order of this Court, a custody report was called for from the concerned Jail Authority. The custody report has been submitted before this Court and the same is taken on record. 5. As per the custody report, convict–Rajesh alias Binu, S/o Aman Singh, R/o Village Delna, Police Station Jhabreda, District Haridwar, was convicted in Case Crime No. 107 of 2021 under Sections 323 and 506 IPC and Section 9/10 of the POCSO Act. He was admitted to jail on 30.07.2022. As per the report, as on 13.11.2025, he has undergone incarceration for a period of four years, eight months and one day against the total sentence awarded (including a sentence of five years). 6. In view of the custody period already undergone by the Appellant and considering the total sentence awarded, this Court is of the opinion that nothing further survives for adjudication in the present appeal. 7. Accordingly, the present Criminal Jail Appeal stands disposed of in terms of the sentence already undergone by the Appellant. 2026:UHC:1068 8. Let the Appellant be released on bail upon his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the learned Trial Court. 9. Let a copy of this order be communicated to the concerned Jail Superintendent forthwith for compliance. 10. Let the record be consigned to the Record Room. 11. Trial Court’s Record be sent back to the concerned Court.
