Heard Mr. A M Ahmed, the learned counsel appearing for the applicant. Also heard Mr. K K Das, the learned Addl. Public Prosecutor appearing for the State of Assam.
2. This application has been filed under Section 430 of the BNSS, 2023 praying for suspension of sentence and for allowing the applicant to remain on previous bail.
3. I have gone through the impugned judgment. I have also considered the submissions made by the learned counsel of both sides.
4. It is hereby directed that the sentence imposed upon the applicant Md. Habej Ali @ Habij by the learned Sessions Judge, Lakhimpur, North Lakhimpur, Assam vide impugned judgment dated 03.12.2025 in Sessions Case No.83(NL)/2023 shall remain suspended till disposal of the appeal.
5. It is further directed that the applicant Md. Habej Ali @ Habij is allowed to remain on previous bail till disposal of the connected appeal. With the aforesaid direction, this IA stands disposed of accordingly.
