Order No.4 / Dated : 27.01.2026. Heard both the sides. All the aforesaid three bail applications arising out of common FIR, as such, they are being heard together and disposed of, by this common order. The petitioners, above-named who are in custody in connection with Sisai (Gumla) P.S. Case No. 84 of 2025 for the offence registered under Section 309(4) of the B.N.S., 2023 have prayed for grant of regular bail. The matter involves committing highway robbery by intercepting a pick-up van by another vehicle i.e. Bolero. It is submitted by the learned counsel on behalf of petitioner [Manoj Mahli & Anr. in B.A. 9644 of 2025] that there is no legal

evidence against petitioner (Manoj Mahli) as he has neither been identified in TIP nor any looted article has been recovered on the basis of his disclosure statement and further he has no criminal antecedent. So far the prayer for other petitioners are concerned, it is submitted that the confessional statement made before the Police has got no evidentiary value and they are languishing in custody since
18.07.2025. Learned A.P.P. for the State has opposed the prayer for bail. It is submitted that so far prayer for bail of petitioner- Manoj Mahli is concerned, his name has come in the confessional statement of co- accused on the basis of which, the looted article was recovered. So far the prayer for petitioner [Punai Oraon] is concerned, on his disclosure statement, looted article was recovered as will be evident from Para-77 of the case diary. Further one looted mobile was seized from the petitioner [Kalesh Gope @ Kaleshwar Gope]. Further so far prayer for bail of petitioner [Manoj Oraon] is concerned, his name has come on the confessional statement of the co-accused and looted articles were recovered from him and he has many criminal antecedents. Considering the gravity of offence and materials on record, the prayer for bail of all the petitioners except petitioner [Manoj Mahli in B.A. 9644 of 2025] stand rejected. However, considering the materials on record, the prayer for bail of the petitioner [Manoj Mahli in B.A. 9644 of 2025] is allowed. Accordingly, petitioner [Manoj Mahli in B.A. 9644 of 2025] is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
