None appears for the Panchayat despite service. It is not in dispute that the writ petitioner and the private respondent are co-owners of the plot in question. A partition suit is pending between them. The petitioner alleges that the private respondent has raised construction in a portion of the plot under ‘Banglar Bari’ scheme which was illegally allotted in his favour by the concerned authorities. The petitioner submitted a representation ventilating his grievance before the concerned authority on 10th February, 2026 which is yet to be considered. The petitioner seeks consideration of the same. Learned counsel for the private respondent submits that the construction has been completed. Since the representation submitted by the petitioner before the concerned authority is pending, 2 the Pradhan, Jara – II Gram Panchayat, being the 5th respondent herein, is directed to consider and dispose of the same within six weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is accordingly disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
