Ct. No.15 b.das
WPA 24304 of 2026
Bhudeb Majhi Vs. The State of W. B. & Ors.
Mr. Timir Baran Saha …for the petitioner.
Mr. Anup Dasgupta Mr. Goutam Acharya …for the State.
Report submitted by the State is taken on record. The report does not respond to the contention of the petitioner in the writ petition. It appears from the order impugned passed by the Executive Officer, Hariharpara Panchayat Samiti on 1st August, 2026 that Protappur (Rukunpur) Ferry Ghat under Hariharpara Panchayat Samiti was declared toll free for the public from 1st August, 2026 in terms of an
order passed by this Court on 31st July, 2026 in WPA 15822 of 2026.
Learned counsel for the petitioner takes this Court of the order dated 31st July, 2026 passed in WPA 15822 of 2026 wherein the e-auction floated by the Hariharpara Panchayat Samiti on 25th June, 2026 which was assailed in the said writ petition was restrained from being acted upon till 21st August, 2026. This Court is informed that the said writ petition is still sub judice.
2 It is not understood how the Executive Officer declared the ferry ghat to be toll free in terms of the order dated 31st July, 2026 when there was no reflection in the said order at all. The order impugned is misconceived and without any basis whatsoever. The said order is required to be quashed. Accordingly, the order impugned dated 1st August, 2026 passed by the Executive Officer, Hariharpara Panchayat Samiti is quashed/set aside. Since admittedly the petitioner has been running the said ferry ghat, he shall continue to operate the same till the auction/tender remains valid. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
