……for the Petitioner.
Learned advocate appearing for the petitioner submits petitioner was not traced at the spot. Recovery was from an abandoned vehicle and the petitioner has been foisted with the present criminal case. There are no documents to suggest that the recovery was from the vehicle of the present petitioner. As such, on any stringent condition petitioner be released on bail.
State opposes the prayer for bail and submits there was recovery of 1596 bottles of Phensedyl. Persons who are in the vehicle fled away immediately when the vehicle was intercepted. The ownership of the vehicle from the documents collected by the investigating agency would reflect complicity of the present petitioner. Other documents have also been collected by the investigating agency to connect the petitioner with the alleged offence.
