Accused no.1 in S.C.No.29/2020 pending before the Court of III Addl. District & Sessions Judge, Shivamogga, arising out of Crime No.552/2018 registered by Tunga Nagar Police Station, Shivamogga, for the offences punishable under Sections 143, 144, 147, 148, 504, 279, 353, 307 read with 149 IPC and Sections 27 & 25(1) of Arms Act, 1959, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. Perusal of the material on record would go to show that petitioner who was arrested in the present case, at crime stage, was granted regular bail by the jurisdictional Sessions Court on 18.11.2020. It appears that subsequently, petitioner had not appeared before the Trial Court in S.C.No.29/2020, and therefore, a split-up case was registered against him in S.C.No.43/2022 and in the said case, he was produced under body warrant on 04.07.2022 and remanded to judicial custody. Subsequently, the split-up case in S.C.No.43/2022 was merged - 3 - HC-KAR CNR: KAHC010655722026 NC: 2026:KHC:53735 CRL.P No. 14695 of 2026 with the main case in S.C.No.29/2020 by order dated 29.07.2025. Thereafter, bail application filed by the petitioner before the Trial Court in S.C.No.29/2020 was rejected on 01.09.2026. Therefore, he is before this Court. 4. It is brought to the notice of this Court by the learned HCGP that petitioner is a person with criminal antecedents. 5. Be that as it may, the fact remains that on merits of the case, petitioner was granted regular bail in the present case by the jurisdictional Sessions Court on 18.11.2020. Thereafter, since he had not appeared before the Trial Court in S.C.No.29/2020, a split-up case was registered against him in S.C.No.43/2022 and in the said case, he was produced under body warrant on 04.07.2022 and remanded to judicial custody. 6. It appears that petitioner who was arrested in Crime No.73/2021 registered by Cubbon Park Police Station, Bengaluru, was produced under body warrant in the present case on 04.07.2022 in S.C.No.43/2022. Learned Counsel for the petitioner has produced the copy of the order passed in Crl. Misc. No.7701/2026 by the jurisdictional Sessions Court, which - 4 - HC-KAR CNR: KAHC010655722026 NC: 2026:KHC:53735 CRL.P No. 14695 of 2026 would go to show that he has been now granted regular bail in Crime No.73/2021 on 11.08.2026. 7. In the present case, though he was granted regular bail earlier, only for the reason that he had jumped bail, he is now remanded to custody with effect from 04.07.2022 onwards. Learned Counsel for the petitioner has submitted that material charge-sheet witnesses have not supported the case of the prosecution in the present case. Petitioner has undertaken to co-operate with the Trial Court for speedy disposal of the case. However, considering his antecedents, his prayer for grant of regular bail is required to be answered affirmatively, subject to appropriate conditions. Accordingly, the following order: 8. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.29/2020 pending before the Court of III Addl. District & Sessions Judge, Shivamogga, arising out of Crime No.552/2018 registered by Tunga Nagar Police Station, Shivamogga, for the offences punishable under Sections 143, 144, 147, 148, 504, 279, 353, 307 read with 149 IPC and - 5 - HC-KAR CNR: KAHC010655722026 NC: 2026:KHC:53735 CRL.P No. 14695 of 2026 Sections 27 & 25(1) of Arms Act, 1959, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off; f) The petitioner is directed to appear before the Station House Officer, Tunga Nagar Police Station, Shivamogga, on the first and third Sunday of every month between 10.00 a.m. and - 6 - HC-KAR CNR: KAHC010655722026 NC: 2026:KHC:53735 CRL.P No. 14695 of 2026 01.00 p.m. and mark his attendance, till the disposal of S.C.No.29/2020.
