The petitioner who is a member of Alipur II Gram Panchayat and the leader of a recognized political party referred to in sub-section (3) of Section 213A of the West Bengal Pachayat Act, 1973 submitted an application under Section 213 A of the West Bengal Panchayt Act, 1973 for seeking disqualification of the 9th respondent/member of the Panchayat which was received by the BDO, Kaliachak I, Malda being the 7th respondent herein on 9th August, 2024. The application is still pending. It is clearly enumerated in Section 213 A (9) of the Act of 1973 that such application ought to be proceeded with as soon as possible, within six weeks from the date of receipt thereof. Unfortunately the 7th respondent has not found it necessary to comply with the said provision of law. The 7th respondent is directed to deal with the application and pass a reasoned order in terms of the said provision of law within two weeks from the date of communication of this order. The writ petition is disposed of. There shall be no order as to costs.
2 Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
