This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 68/2025 registered at Police Station Odgi, District Surajpur (CG) for the offence punishable under Section 107 of the BNS 2023. 2. As per the prosecution case, after recording merg intimation the police investigated the matter and during Panchnama proceedings informant Jawahar Lal Cherwa and witnesses Rajni Cherwa & ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2026.01.27 17:30:55 +0530 2 Baisakhi Cherwa residents of Palkevara were questioned and detailed statements were recorded. They told in their statements that on 05.09.2025 at about 01.00 pm, elder father’s daughter-in-law Geeta Cherwa came to the informant’s house and picked a quarrel with his sister, deceased Kaushalya who was unmarried girl of aged about 14 years, by talking nonsense about old enmity regarding land property. After quarreling for a long time and harassing the informant’s sister the applicant went back to her home. Then the informant Jawahar Lal had gone to his uncle Manuram’s house. After some time when informant came back to his house, he found that the door was closed. The informant called out and when there was no response from inside, he broke opened the door and saw that his sister was hanging. It is alleged that being harassed and upset by the quarrel of the accused applicant, the deceased committed suicide by hanging herself in the beam of the house. Since it was found in the merg investigation that the said offence u/s 107 BNS had taken place, crime was registered against the applicant and she has been arrested. 3. Learned counsel for the applicant submits that the applicant is a lady aged about 35 years and there is interse family relations between the accused and deceased as the accused happens to be daughter-in-law of elder-father. He submits that no offence as alleged u/s 107 of the BNS is made out against her and only heat exchange of words had taken place arising out of old family and property dispute which does not constitute abetment of suicide as according to the prosecution case itself, after the alleged quarrel the applicant had left the house of the informant and returned to her home. There is no direct nexus between the alleged conduct of the applicant and the act of suicide so as to connect the applicant in crime in question. He further submits that there are total 14 witnesses yet to be examined in this case; the trial has not yet commenced; the applicant is in jail since 01.11.2025 and there is no immediate possibility of disposal of case, therefore, she may be enlarged on bail. 3 4. Per contra, learned State Counsel opposes the bail application and submits that the applicant had gone to the house of informant and picked a quarrel with his sister (deceased), therefore, being harassed with the quarrel picked by the applicant, the deceased committed suicide. 5. Having considered the submissions made by learned counsel for the parties and the material available on record as also the fact that the trial has not yet commenced, I am inclined to release the applicant on bail at this stage. 6. Accordingly, the bail application is allowed and the applicant Geeta Cherva is directed to be released on bail on furnishing a bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for her appearance before the said Court as and when directed in that behalf.
