Item- 35. sg 23-09-2026 Ct. 6 CO 3311 of 2026 Sourabh Krishna Datta Versus Soma Datta (nee Bhakta) Mr. Amitava Pain Mr. Partha Pratim Mukherjee Ms. Aparna Dhali …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, Fast Track Court-III, Barrackpore to conclude the cross- examination, expeditiously. The learned advocate appearing for the petitioner draws the attention of this Court to an order dated 2nd September, 2025 passed in CO 3199 of 2025 whereby direction was passed by the learned trial judge to dispose of the Matrimonial Suit expeditiously. He submits that till date, the cross-examination has not been completed. He further submits that 7th October, 2026 is fixed for cross-examination of the PW-1. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned advocate for the petitioner, this civil revision application is disposed of by requesting the learned Additional District Judge, Fast Track Court-III, Barrackpore, to take up the suit for cross-examination of PW-1 and make an endeavour to 2 conclude the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After the cross-examination of the PW-1 is concluded, the learned trial judge shall make an endeavour to dispose of the Matrimonial Suit No. 1447 of 2022 as expeditiously as possible but preferably within a period of nine months from the next date fixed before the learned trial judge without granting any unnecessary adjournment to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Hiranmay Bhattacharyya, J.)
