It is the contention of the learned counsel for the petitioners submits that, one of the petitioners suffered a serious injurious and the incident has taken place on 11.10.2025 and though the complaint was filed by one of the petitioners, the police did not taken any action. Thereafter, the petitioners have brought it to the notice of the higher officers and thereafter, the action was taken and a charge sheet is filed against the complainant and other family members. Since, the FIR was registered against the complainant/Respondent No.2 has filed the complaint three days after the alleged incident. It is the contention that it is a counter blast to the complaint filed by the petitioners and that the alleged incident has not taken place. 4. Learned Additional SPP would submit that the police have investigated both the complaints and charge sheet filed in both the cases. It is submitted that since there is a case and counter case, the presence of the parties at the time of alleged offence is admitted and on Digitally Signed by ANANT RAMNATH HEGDE - 4 - HC-KAR CNR: KAHC010283502026 NC: 2026:KHC:52666 CRL.P No. 6180 of 2026 both sides there are injuries and wound certificate would reflect the injuries. 5. The Court is of the view that the contentions raised by the petitioners are based on disputed questions of facts. The contention that the petitioners have not committed any offence cannot be accepted at this stage. The Matter requires trial. 6. Accordingly, petition is dismissed. 7. It is made clear that observations made in this order are only confined to the merits of the petition under Section 528 of Bharatiya Nyaya Sanhita, 2023 and not on the merits of the defence to be raised by the petitioners. All contentions kept open. (ANANT RAMANATH HEGDE) JUDGE BRN List No.: 2 Sl No.: 17 Digitally Signed by ANANT RAMNATH HEGDE
