By this application, the petitioner has prayed for bail in connection with Page No.# 2/3 Hatigaon P.S. Case No. 29/2026 registered under Sections 21(b) of the NDPS Act, 1985. The FIR dated 13.02.2026 reveals that on a source information about dealing of drugs at the place of occurrence, the police personnel reached the house of the petitioner and on search being made, a soap case containing suspected heroine weighing about 100 gms without soap case and 41 gms with soap case was recovered from the place of petioner. It is also alleged that petitioner along with owner of the room has been dealing in drugs. Mr. A. Rashid, learned Counsel for the petitioner submits that the petitioner is a 20 year old girl and she has been inside the jail for 26 days. He further submits that the owner of the room is a maternal uncle of the petitioner and that she has no connection with the instant offence. Mr MP Goswami, learned Additional Public Prosecutor appearing for the State submits that even if the petitioner is a young girl of 20 years of age but contrabands were found from her house, which she had taken on rent and during investigation, it was also found that she along with her maternal uncle used to deal in drugs business. As such she objects to the grant of bail. On consideration of the submissions made by the counsels and more so due to the fact the petitioner is a 20 year old girl and her future is at stake and that drugs were found from the rented place of the petitioner, this Court deems it fit that the petitioner be released on bail on furnishing of bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of CJM, Kamrup (M) under the following conditions: i) The petitioner will appear before the Trial Court as and when call for. ii) The petitioner will not influence the witnesses Page No.# 3/3 connected with the case.
