This is the First bail application :led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 401/2025 registered at Police Station – Koni, District – Bilaspur (C.G.), for the o>ence punishable under Sections 105 and 3(5) of the Bhartiya Nyaya Sanhita,

The prosecution story, in short, is that the Police Station Koni, District Bilaspur (C.G.), registered a merg in respect of the death of Ramu Ram Sunahle, S/o Late Babai Ram Sunahle, aged about 57 years, resident of Village Lofandi, P.S. 2 report of the deceased, methanol and ethanol were detected. The prosecution has alleged that the applicant mixed chemicals such as methanol and ethanol in the liquor consumed by the deceased. Accordingly, the police registered Crime No. 401/2025, conducted the investigation, and :led the charge-sheet under Sections 105 and 3(5) of the B.N.S.
3. Learned counsel for the applicant would submit that the present applicant is innocent person and has been falsely implicated in this case. He further submits the applicant has been implicated by the prosecution solely on the basis of the memorandum statement of the co-accused, namely Bande Kumar Loniya. The co-accused was engaged in the manufacture of country-made liquor and used to supply the same to the husband of the applicant, namely Komal Lahre. He also submits that the incident occurred on 05.02.2025, in which four persons died after consuming country-made liquor supplied by the co-accused Bande Loniya. In fact, the deceased Komal Lahre was also a habitual consumer of liquor along with the other deceased persons. The said Komal Lahre died on 07.02.2025 due to the consumption of poisonous liquor.
He further submits that the incident occurred on 05.02.2025, and the police initially conducted a merg inquiry in respect of the deaths of four persons caused by the consumption of poisonous liquor. However, the prosecution did not investigate the cause of death of the husband of the applicant, namely Komal Lahre, who was also a habitual consumer of liquor along with the said four deceased persons. There is a delay in lodging the F.I.R. in the present crime. The applicant is a housewife whose husband died on 07.02.2025 due to the consumption of poisonous liquor. He also submits that the applicant is in jail since 28.08.2025, conclusion of the trial may take some time, therefore, he prays for grant

On the other hand, learned State Counsel opposes the bail application of the present applicant and submits that the allegation against the applicant is that she mixed chemicals such as methanol and ethanol in the liquor consumed by the deceased, namely, Ramu Ram Sunahle, resident of Village Lofandi, Police Station Koni, District Bilaspur (C.G.). It is further submitted that, as per the F.S.L. report, methanol and ethanol were detected in the viscera of the deceased. She further submits that the bail applications of the present applicant in other cases have been rejected by this Court MCRC No. 10248 of 2025, MCRC No. 10278 of 2025 and MCRC No. 10308 of 2025 vide order dated 12.12.2025, therefore, the present bail application of the present applicant is also entitled to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and the fact that the allegation against the applicant is that she mixed chemicals such as methanol and ethanol in the liquor consumed by the deceased, namely, Ramu Ram Sunahle, resident of Village Lofandi, Police Station Koni, District Bilaspur (C.G.). As per the F.S.L. report, methanol and ethanol were detected in the viscera of the deceased.
The bail applications of the present applicant in other cases, namely MCRC No. 10248 of 2025, MCRC No. 10278 of 2025, and MCRC No. 10308 of 2025, were rejected by this Court vide order dated 12.12.2025, therefore, this Court is of the opinion that it is not a :t case to enlarge the applicant on bail in the present case also. 7. Accordingly, the bail application of the applicant – Panchwati Alias
4 Panchbai Alias Pancho Lahre, :led under Section 483 of the BNSS, involved in Crime No. 401/2025 registered at Police Station – Koni, District – Bilaspur (C.G.), for the o>ence punishable under Sections 105 and 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. O3ce is directed to send a certi:ed copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
