And In the matter of : Masadul Sk ……Petitioner. Mr. Subhrajyoti Ghosh Mr. Md. Reazul Hoque ……for the Petitioner. Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick ……for the State. Learned advocate for the petitioner submits that petitioner is in custody for 307 days. The recovery in the present case is 288 Gms. of Heroin and there has been no quantification in respect of the contraband seized. Learned advocate for the State submits that recovery was from the house of the present petitioner. Having considered the issue of quantification canvassed by the present petitioner, I am of the opinion quantification is subjective and the same can be assessed after the cross- examination of the Chemical Examiner. The same being question of fact, at this stage, I am not inclined to release the petitioner on bail. 2 Accordingly, prayer for bail of the petitioner in CRM (NDPS) 2032 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
