Chowdhury, learned counsel for the petitioner. Also heard Mr. K.K. Das, learned Additional Public Prosecutor appears for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioners, Nazam Uddin and Samim Uddin have prayed for releasing them on bail after he was arrested in connection with Special Sessions POCSO Case No. 26/2025 corresponding to Ratabari P.S. Case No.52/2025 registered under Sections 137(2)/65(1)/108 of BNS, 2023 read with Section 4 of the POCSO Act, 2012. 3. It is submitted that the petitioners were arrested on 31.12.2025 and since then they spent 96 (ninety six) days in custody. 4. The learned Additional Public Prosecutor appears for the State of Assam upon instructions received submits that charge-sheet have not been submitted as yet. 5. In view of the above, the petitioners are entitled to default bail. Accordingly, it is directed that the petitioners are released on bail of ₹50,000/- (Rupees fifty thousand) only each with two sureties of like amount to the satisfaction of the learned Special Judge, Sribhumi in connection with Special Sessions POCSO Case No. 26/2025.
