1. Affidavit-of-service filed on behalf of petitioner is taken on record.
2. In spite of service of notice State respondents are not represented.
3. However, respondent no.6 is represented by learned advocate.
4. It is submitted by learned advocate representing petitioner that prayer is made for directing concerned police authorities to register FIR based on complaint lodged. Liberty is prayed for on behalf of petitioner to approach jurisdictional Magistrate under Section 175(3) of BNSS, 2023.
5. In view of such submission made on behalf of petitioner, writ petition stands disposed of thereby granting liberty to petitioner to approach jurisdictional Magistrate.
6. It is clarified that if jurisdictional Magistrate is approached under Section 175(3) of BNSS, 2023,
decision shall be taken without being influenced by the order passed today on this writ petition.
