The petitioner named above has been made accused in connection with Mandu (Kuju) P.S. Case No. 147 of 2021 (S.T. No. 133 of 2021) for the offence registered under Sections 302/34 of the Indian Penal Code, pending in the court of learned Sessions Judge, Ramgarh. Earlier the prayer for bail of the petitioner was rejected on merit on 26.07.2024 and the present bail application is being renewed on the ground that the petitioner is in custody for more than four and half years and not a single witness has been examined. It is submitted by learned counsel for the petitioner that other co- accused persons have been granted bail. A report was called for from the Trial Court regarding stage of the trial from which it appears that the charge was framed on 01.06.2022, but till date, not a single witness has been examined. Learned counsel for the State has opposed the prayer for bail. Considering overall facts and circumstances of the case and the stage of trial, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
