By way of these petitions, petitioners have prayed that they have filed representations to provide them benefits in terms of the judgment, passed by a Coordinate Bench of this Court in CWP No 2056 of 2023, titled as Ghanshyam Dass and Ors. Vs. State of H.P. and Ors., decided on 21.03.2024 alongwith connected matters.

Learned counsel representing the petitioners submits that in case the direction is given to the respondents to consider the claim of the petitioners in view of the dictum passed by this Court in aforementioned petition, petitioners shall be satisfied.

Faced with this situation, learned Additional Advocate General submits that the respondents/Competent Authority may examine the cases of the petitioners in light of the dictum passed by the Coordinate Bench in the aforementioned case and if the petitioners are similarly situate as that of Ghanshyam Dass and Ors. (supra), the Competent Authority shall also granted the same relief to them.

Keeping in view the prayers having been made by
learned counsel for the petitioners, this Court is of the view that instead of calling the reply from the respondents, it would be in the interest of justice, that the claim of the petitioners as highlighted by them in the representations is firstly considered by the respondents and in case they are similarly situate, the respondents shall extend the same benefits to them. Therefore, it is ordered that in case the petitioners are similarly situate as that of the petitioners in the
judgment referred above, same and similar benefits shall be extended to the petitioners within a period of eight weeks from the date of the receipt of the order passed by this Court.

These writ petitions are, accordingly, disposed of, so also the pending miscellaneous application(s), if any.
