D/L.47 Rakib (Allowed) CRM (NDPS) 373 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Hogolberia Police Station case no. 309 of 2025 dated 14.10.2025 under Sections 20(b)(ii)(c)/29 of the of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In the matter of : Akbar Mondal. ……Petitioner. Mr. Asraf Mandal ……for the Petitioner. Mr. Arindam Sen Mr. Amanul Islam ……for the State. Learned advocate for the petitioner submits that petitioner was implicated in connection with the instant case for alleged recovery of 27.5 kgs of ganja and petitioner is in custody for about five months and already charge-sheet has been submitted before the jurisdictional Court. Learned advocate for the State opposes the prayer for bail and submits that 10 witnesses will be relied upon by the prosecution to prove its case. Having considered the quantum of recovery and the period of detention, I am of the view that further incarceration is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, petitioner namely, Akbar Mondal shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten 2 Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act, Nadia, Krishnagar. If on bail, the petitioner shall be physically present on each and every date fixed before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of Nadia without the prior permission of the learned Special Court. Thus, the prayer for bail in CRM (NDPS) 373 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
