Learned advocate appearing for the petitioner submits that the incident complained of is of 2020. Petitioner is innocent and has been implicated after there has been change in administration. Learned Additional Public Prosecutor appearing for the State vehemently object to the anticipatory bail as the petitioner by using his office has deprived the informant and other family members of their dues. There were accusations of extortion, pressure and illegal construction being raised at the behest of the present petitioner. Petitioner at the relevant point of time was a public representative who created pressure and till date did not part with the dues of Rs.10,50,000/-. I have taken into account the period when the alleged offence has taken place, although, a case for investigation has been made out but custodial detention of the present petitioner is unwarranted.
2 As such, prayer for bail of the petitioner namely, Bapi Ghosh is allowed. Accordingly, in the event of arrest, the petitioner shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Additionally, petitioner shall once in a week report to the Shyampukur police station/investigating officer of the case till further orders of this Court. Accordingly, CRM (A) 3048 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
