Order This Writ Petition has been filed seeking a direction to the 4th respondent to consider the petitioners’ applications for patta transfer with subdivision dated 11.03.2026, and to issue separate pattas to each of the petitioners in accordance with the registered Will. 2. The learned counsel for the petitioners submitted that the petitioners are the absolute owners and are in possession of the property situated in S.F. No. 47/13, Jawahar Nagar, Chennai. The said property was originally purchased by the petitioners’ father, and following his demise, the petitioners partitioned the property among themselves and have been in continuous possession and enjoyment of their respective shares. Since the revenue mutation was not effected after their father's demise, the petitioners applied for a patta transfer https://www.mhc.tn.gov.in/judis WP No. 23821 of 2026 __________ Page3 of 6 with subdivision on 11.03.2026. However, it came to the knowledge of the petitioners that while the revenue records for S.F. No. 47/13 originally stood in their father's name, there is a clerical error/misprint in the patta, wherein the owner's name reflects as "Nagappa Mudaliyar" instead of "Narasimha Mudaliyar". Despite multiple representations seeking a correction of this typographical error, the mistake has not been rectified by the respondents. Aggrieved by the non-consideration of their applications for patta transfer and subdivision, the petitioners have approached this Court. 3. The learned Government Advocate appearing for the respondents submitted that the patta currently stands in the name of one Nagappa Mudaliyar and not in the name of Narasimha Mudaliyar (the petitioners’ father). Therefore, the petitioners must first take appropriate steps to seek a correction in the entry of the revenue records before claiming any further relief. 4. The relief sought in this Writ Petition is for a direction to consider the representations for a patta transfer with subdivision. The petitioners are seeking the issuance of fresh, individual pattas. If the petitioners' father's name been correctly recorded in the parent patta, the same will be directly mutated or transferred in favour of the petitioners. However, the name of a third party, Nagappa Mudaliyar, currently appears in the revenue entries. Therefore, the petitioners must first take steps to rectify this error by seeking the removal of https://www.mhc.tn.gov.in/judis WP No. 23821 of 2026 __________ Page4 of 6 the name "Nagappa Mudaliyar" and the inclusion of "Narasimha Mudaliyar" in the revenue records. 5. Accordingly, the petitioners are directed to submit a fresh application for the correction/rectification of the entry in the patta before the competent revenue authority. Upon receipt of such an application, the 3rd respondent shall consider the same and pass appropriate orders on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioners as well as any other interested or aggrieved parties, within a period of eight weeks from the date of receipt of a copy of this order. Once the revenue entry is rectified, the petitioners are at liberty to submit a fresh application for subdivision and issuance of individual pattas in their names. 6. This Writ Petition is disposed of with the above observations. No costs. Connected W.M.P.
