The State of West Bengal Mr. Jyotirmoy Som, Mr. Archo Ghosh …for the petitioner In this application, the petitioner has prayed for a direction upon the Court below for expeditious disposal of the proceeding being G.R. Case 2131 of 2018 pending before learned Judicial Magistrate, 1st Court, Paschim Medinipur contending that since 24th January, 2020 the case is pending before the Trial Court and till date only P.W.1 has been examined in part so far and the prosecution proposes to examine 15 witnesses. Due to long pendency of the proceeding, the petitioner has been suffering mental anxiety and trauma and, therefore, he prays for necessary direction. Having heard learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and, as such, the service of copy of application upon the opposite party is dispensed with. Having considered the submission made on behalf of the petitioner, it appears that the prayer made by the petitioner is justified in view of long pendency of the proceeding and, as such, the instant application being CRR 107 of 2026 is hereby disposed of with a direction upon the Trial Court to make his best endeavour to expedite the trial and he will make his best effort to conclude the trial preferably within a 2 period of six months from the next date of hearing without granting any unnecessary adjustment to either of the parties. This order is passed invoking this Court’s jurisdiction under Section 529 of the BNSS.
