The second bail application has been filed under Section 483 of BNSS, 2023 on behalf of accused-petitioner in connection with FIR No. 385/2025 registered at Police Station Saket Nagar, District Beawar for offences punishable under Sections 115(2), 126(2), 109(1) and 189(2) of BNS, 2023 in F.I.R. and against the order dated 15.11.2025 whereby learned Trial Court dismissed the bail application filed by the accused-petitioner for the offence punishable under Sections 115(2), 126(2), 109(1), 189(2) and 61(2) of BNS, 2023. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner is in judicial custody since 26.10.2025 and Police after completion of investigation, has submitted charge- sheet in the matter. He further submits that none of the injury [2026:RJ-JP:8671] (2 of 3) [CRLMB-1137/2026] sustained by the complainant has been opined to be dangerous to life. 3. Learned Public Prosecutor opposed the bail application and submits that the accused-petitioner along with other accused made attack on the complainant and the injured Chetan Singh while they were going on a motorcycle. He submits that in the alleged incident the injured Dushyant Singh sustained as many as eleven injuries and out of which three injuries have been found to be grievous in nature. The injured Chetan Singh has also sustained as many as eight injuries out of which injury No. 8 has been opined to be grievous in nature. 4. Considered the submissions made at Bar and perused the case diary, injury report and x-ray report. 5. There are specific allegations against the present accused-petitioner and Lakshman Singh, Rakesh, Hari, Ramesh, Javed and Prahalad of causing injuries to the complainant and the injured Chetan Singh. On perusal of the injury report Dushyant Singh has been sustained as many as eleven injuries. After x-ray report injury Nos. 2 and 3 have been opined to be grievous in nature. The Dushyant Singh has sustained fracture on both legs as well as right hand. The other injured Chetan Singh who has sustained as many as eight injuries has also suffered fracture at left hip joint. The manner in which the complainant and the injured have been attacked if the accused-petitioner is released on bail the Court feels that the injured witnesses may not be able to give the uninfluenced evidence. In view of the above and the taking into consideration the overall facts and circumstances of the case, this Court is not inclined to enlarge the accused-petitioner on bail. 7. Accordingly, this bail application is dismissed. 8. However, accused-petitioner shall be at liberty to file fresh bail application after examination of both injured witnesses namely- Dushyant Singh and Chetan Singh.
