Kausik (Allowed) CRM (M) 1860 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nodakhali Police Station Case No. 108 of 2023 dated 21.04.2023 under sections 302/201 of Indian Penal Code. And In the matter of : Arman Khan ……Petitioner. Mr. Soumya Nag Ms. Sampriti Saha Mr. Rajdeep Sengupta Mr. Moyukh Majumder ……for the Petitioner. Mr. Somopriyo Chowdhury Ms. Deblina Bhattacharjee ……for the State. Learned advocate appearing for the petitioner submits that petitioner was arrested on 21.04.2023 and till date pursuant to the earlier direction by this Court more than 6 witnesses have been examined. Prosecution intends to examine in all 24 witnesses. There is no possibility of the trial being concluded in near future. As such, petitioner be released on bail as rest of the accused persons were below 18 years and it is petitioner only who is above 18 years solely facing the trial. Learned advocate for the State opposes the prayer for bail and submits that the recovery of the blade and the wearing 2 apparels were recovered at the behest of the present petitioner. The serological report matches with the blood stain recovered from the wearing apparels. I have taken into account the period of detention of the present petitioner. Police report do not reflect that there are criminal antecedents. Some time will be required to take the trial to its logical conclusion as also the tender age of the present petitioner. Having regard to the overall view, I direct the petitioner to be released on bail. As such, petitioner, namely Arman Khan be enlarged on bail subject to furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Alipore. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned Trial Court. Additionally, petitioner shall not enter the jurisdiction of Nodakhali Police Station and would meet with the Officer-in- Charge of the local police station where he would be residing. Once a week petitioner shall attend such police station and submit the attendance before the Trial Court on the date fixed for the trial. 3 If there are violations of the condition, learned Trial Court would cancel the bail without further reference to this Court. Accordingly, CRM (M) 1860 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
