Mr.Durai Gunasekaran, Govt's Advocate (Crl.Side) for R3 https://www.mhc.tn.gov.in/judis WP No. 23854 of 2026 __________ Page2 of 6 Order This Writ Petition has been filed to direct the 2nd respondent to conduct a survey of the petitioner’s land and to direct the 3rd respondent to provide police protection while the 2nd respondent performs the survey duty, based on the 1st respondent's communication letter dated 13.01.2025. 2. The learned counsel appearing for the petitioner submitted that the petitioner is the absolute owner of the land in S.F. No. 10/2 and 69/1 at Vettavalam Village, Naivanatham Taluk, Thiruvannamalai District, measuring an extent of 2 acres and 48 cents. The petitioner, in order to identify his boundaries, had applied to the 2nd respondent for the measurement of his land. However, the 4th respondent unfortunately restrained the officials from discharging their survey duties. In this regard, the petitioner also filed a criminal complaint before the 3rd respondent. Thereafter, the petitioner made another online application for a survey on 17.09.2025, but the 4th respondent obstructed the process on that occasion as well. 3. Meanwhile, the 1st respondent issued proceedings dated 13.01.2025 to take necessary action against the 4th respondent for restraining the 2nd respondent from performing his duties, and also recommended providing police https://www.mhc.tn.gov.in/judis WP No. 23854 of 2026 __________ Page3 of 6 protection. However, the 3rd respondent has not acted upon the said communication. The petitioner once again applied to the 2nd respondent for a survey of his land through an online application dated 25.03.2026. However, till date, the petitioner’s land has been neither surveyed nor demarcated. Aggrieved by this inaction, the petitioner has approached this Court. 4. The learned Government Counsel appearing for respondents 1 and 2 submitted that the petitioner’s land will be surveyed based on his last online application dated 25.03.2026, along with the necessary police aid, within a timeframe fixed by this Court. 5. Heard the learned counsel for the petitioner as well as the learned Government Counsel appearing for the respondents. Since no adverse orders are being passed against the 4th respondent, notice to him is dispensed with. 6.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the respondents 1 and 2 to consider the petitioner’s online application dated 25.03.2026 and conduct a survey of the subject properties, within a period of four (4) weeks from the date of receipt of a https://www.mhc.tn.gov.in/judis WP No. 23854 of 2026 __________ Page4 of 6 copy of this order, after issuing prior notice and affording an opportunity of personal hearing to the petitioner and other parties concerned including the 4th respondent. If any need arises for Police assistance, it is open to the official respondents to request for Police protection from the 3rd respondent/jurisdictional Police. If any such request is made, the 3rd respondent/jurisdictional Police is directed to provide an adequate Police protection for conducting the survey. 7.In the event of any dispute regarding possession, the official respondents shall not adjudicate upon the question of title. The petitioner and the concerned parties are at liberty to approach the competent Civil Court for recovery of possession and for appropriate reliefs in accordance with law. The official respondents shall not involve themselves in such proceedings or take any action affecting the rights of the parties unless specifically directed by the competent Civil Court. 8.With the above direction, this writ petition is disposed of. No costs.
