1. Learned counsel for the petitioners submits that the trial in Sessions Case No. 300 of 2023 arising out of Tamna Police Station Case No. 157 of 2022 dated 21.08.2022 under Sections 341/324/326/307/34 of the IPC, which is the substratum of challenge in the instant criminal revisional application, has already commenced and the examination of some of the witnesses have been concluded.
2. Learned counsel for the petitioners fairly submits that the trial of the aforesaid criminal proceeding since has already progressed, the revisional application has been rendered infructuous, as such he prays for dismissal of it.
3. Learned Counsel for the State has no objection to the submission made by the learned counsel for the petitioners.
4. In view of the aforesaid development, this Court is of the view that no useful purpose would be served by keeping the present criminal revisional application alive.
5. Accordingly, C.R.R. 2033 of 2024 is dismissed as infructuous.
6. Interim order, if any, stands vacated.
7. There shall be no order as to costs.
8. Urgent photostat copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
