NARASINGH Order No. ORDER 24.04.2026 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is an accused in connection with G.R. Case No.353 of 2025, pending on the file of learned J.M.F.C. Nischintakoili, arising out of Nischintakoili P.S. Case No.178 of 2025, for commission of alleged offences under Section 309(4) of the B.N.S., 2023. 3. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court. 4. Being aggrieved by the rejection of his application for bail U/s.483 of BNSS by the learned Additional Sessions Judge, Salipur by order dated 16.02.2026 in the aforementioned case, the present BLAPL has been filed. 5. The prosecution case in brief is that on 08.09.2025 at about 8 p.m. while the Informant working as Asst. Teacher of Doctor Dev Mohatny Public School since last six years, was proceeding to the school on her scooty, on the way in between Budhagaon to Khandasahi two unknown persons came in black colour bike and detained her and snatched away gold chain from her neck, one mobile phone , key of her scooty and cash of Rs.1,700/- by showing bhujali by assaulting her. 6. It is submitted by the learned counsel that since the Petitioner is in custody since 25.10.2025, he may be released on bail. 7. Such submission is opposed by the learned counsel for the State referring to the materials on record indicating that both the Petitioner and stolen property have been identified in T.I. parade and he is historysheeter. 8. Considering such submission, this Court is not inclined to entertain the bail application of the Petitioner. Liberty is granted to renew his prayer before the learned Court in seisin after examination of the Informant. 9. Accordingly, the BLAPL stands disposed of. U.C.C as per rules. (V.
