GP FOR FINANCE PLANNING The Court made the following: 4 SRK, J WP.No.14605 of 2026 O R D E R This Writ Petition is filed seeking the following relief: “….to issue a Writ, Order, or Direction more particularly one in the nature of Writ of Mandamus or any other appropriate writ or direction declaring the action of the respondents in withholding the payment of balance of Rs.11,60,336/- even after finalizing the bills, payable to the petitioner in relation to the works under GGMP Grant i.e., i) Construction of CC Road from Ramalayam to Vadaparthi Sattibabu (H) in Venkatapuram Village of Upparapalli Secretariat in S. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Panchayat Raj. 3. The petitioner claims to be a registered contractor engaged in the execution of civil works, and that he was entrusted with various works of the Panchayat Raj Department and the Roads & Buildings Department on a tender basis. It is the case of the petitioner that he was awarded a contract for execution of the works under GGMP Grant viz. (1) Construction of CC Road 5 SRK, J WP.No.14605 of 2026 from Ramalayam to VadaparthiSattibabu (H) in Venkatapuram Village of Upparapalli Secretariat in S. Rayavaram Mandal, Anakapalli District (HIW ID.PR. 4882-29524) through Agreement No./2023-24, dated 18-01-2024 for an amount of Rs.2,83,622/-, (2) Completion of incomplete community hall near Ramalayam at Venkatapuram Village of Upparapalli Village Secretariat of S.Rayavaram Mandal, Anakapalli District (HIW ID.PR.4882-14042) through the Agreement No. 2023-2024/ dated 18-01-2024 for an amount of Rs.3,86,326/- and (3) Construction of Community hall near Ramalayam at Venkatapuram Village of Upparapalli Secretariat S.Rayavaram Mandal (10390071) through the Agreement No. 2022-2023, dated 12-04-2023 for an amount of Rs.4,90,388/- totaling an amount of Rs.11,60,336/-. It is the case of the petitioner that he executed the works to the satisfaction of the authorities concerned, and upon completion of the works, the respondents entered the same in the Measurement Books, and the value of the works were assessed at Rs.11,60,336/-. 4. It is the grievance of the petitioner that notwithstanding the completion of the works, the amount due towards the executed works has not been paid till date. According to the petitioner, although the works were completed more than one year ago, the respondent authorities are not releasing the admitted amounts payable to him. Aggrieved by the non-payment of the said amounts, the petitioner filed the present Writ Petition. 5. Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions, from the Executive Engineer, PRI Division, Narsipatnam-7th respondent, submits that there is no dispute with regard to the execution of the works. She further submits that the petitioner is entitled to the amounts of Rs.2,91,515 + Rs.3,90,334 + Rs.4,98,245 totaling at Rs.11,80,094/- after statutory deductions, and that proposals for release of grant were submitted to the authorities concerned, and seeks time for payment of the said amount. The written instructions are placed on record. 6 SRK, J WP.No.14605 of 2026 6. Having regard to the fact that there is no dispute with regard to the works executed by the petitioner and the amount payable to him, and in view of the submissions of the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay a sum of Rs.11,80,094/- to the petitioner within a period of three (3) months from the date of receipt of a copy of this order. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
