38 Ranajit (AR.CT) 23.09.2026 Ct.05 IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction (Appellate Side) W.P.A. NO 24122 OF 2026 Mousumi Khatun -vs- The State of West Bengal & Ors. Mr. Robiul Islam, Sk. Jayed Hossain, Mr. Masooq Rahman, Ms. Sumitra Das ….for the petitioner. Mr. Arka Bhattacharya ….for the State. 1. Affidavit-of-service filed on behalf of petitioner is taken on record. 2. It is submitted that in spite of an order passed by a coordinate Bench on 14th July, 2026 on the writ petition being WPA 15765 OF 2026 (Nowaj Sorif & Ors. vs. The State of West Bengal & Or.) petitioner could not attend panchayat office on the day no confidence motion was scheduled to be moved. It is alleged that petitioner was restrained by concerned police authorities from attending panchayat office to participate in meeting on 4th August, 2026. It is submitted that in this regard a complaint was lodged on 4th August, 2026 before Lalgola Police Station, Murshidabad. 3. State respondents are represented by learned advocates. 4. On perusal of order passed by coordinate Bench on 14th July, 2026, it appears that Court permitted petitioners therein to move no confidence motion and to facilitate such exercise concerned police authorities were directed to render assistance to Prescribed Authority for holding meeting. There was further direction that meeting needs to be held peacefully with the assistance of concerned police authorities. 5. On perusal of complaint dated 4th August, 2026 addressed to concerned police authorities, it appears that prayer is made for permitting petitioner to participate in the meeting where no confidence motion to be moved afresh and appropriate steps to be taken against accused persons. 6. Order passed by the coordinate Bench on 14th July, 2026 is a complete order whereby petitioners in WPA 15765 of 2026 were not only permitted to move no confidence motion by convening meeting under aegis of Prescribed Authority, police authorities were also directed to provide assistance for moving no confidence motion. 7. In view of such order passed by coordinate Bench on 14th July, 2026, no further order need be passed on this writ petition. 8. Writ petition stands disposed of. 9. However, petitioner is granted liberty to approach appropriate forum in pursuit of remedy. 10. Parties to act on the server copy of this order duly downloaded from the official website of this Court.
