The learned counsel for the petitioner submitted that the petitioner’s forefather, namely Govinda Nayakkar, owned various properties across multiple survey numbers in Mahadevimangalam Village, Kancheepuram District. The petitioner’s grandfather, Thirumalai Nayakkar, had three brothers, namely Janakiraman Nayakkar, Srinivasa Nayakkar, and Varatharaja Nayakkar. In the year 1945, the family properties in S.F. No. 141/4, totalling an extent of 5.26 acres, were partitioned among the petitioner’s grandfather and his brothers. Out of the total extent, 1 acre and 11 cents were allotted to Varatharaja Nayakkar; 2.06 acres were allotted to Srinivasa Nayakkar; 1 acre and 12 cents were allotted to Janakiraman Nayakkar; and 1 acre and 3 cents were allotted to the petitioner’s grandfather. Except for the petitioner’s grandfather, all the other brothers sold their respective shares to the 4th respondent, Smt. Mariyammal, https://www.mhc.tn.gov.in/judis WP No. 23939 of 2026 __________ Page3 of 5 who thereby purchased a total of 3.34 acres of land in S.F. No. 141/4. By way of succession, the petitioner is in peaceful possession and enjoyment of his grandfather’s share, measuring an extent of 1 acre and 3 cents. While so, the Government acquired the subject lands for the expansion of the Parandur Airport. The 4th respondent is fraudulently claiming a right over the entire 5.26 acres of land and is attempting to receive the compensation for the entire extent from the official respondents. Hence, the petitioner submitted an objection petition/representation dated 24.03.2026, requesting that the compensation for the land in S.F. No. 141/4 to an extent of 1 acre and 3 cents should not be released to the 4th respondent. Since the said objection has not been considered to date, the petitioner has approached this Court. 3. The learned Government Counsel appearing for respondents 1 to 3 submitted that the petitioner’s objection will be considered by the 3rd respondent in accordance with law, after issuing due notice to the 4th respondent. 4. Heard both sides and perused the materials available on record. Since no adverse orders are being passed against the 4th respondent at this stage, notice to the 4th respondent is dispensed with for the purpose of this disposal. https://www.mhc.tn.gov.in/judis WP No. 23939 of 2026 __________ Page4 of 5 5. Under such circumstances, the 3rd respondent is directed to conduct a proper enquiry after issuing notice to the petitioner, the 4th respondent, and all other interested parties with regard to the disbursement of compensation specifically for the land in S.F. No. 141/4 to an extent of 1 acre and 3 cents, situated at Mahadevimangalam Village, Kancheepuram District. Thereafter, the 3rd respondent shall pass appropriate orders regarding the disbursement of compensation on merits and in accordance with law. The entire exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. 6. This Writ Petition is disposed of with the above observations.
