The instant application has been filed under Sections 483 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of bail in connection with Latehar P.S. Case No. 264 of 2023 corresponding to G.R. Case No.141 of 2024 registered under Sections 147, 148, 149, 171, 385, 387, 120(B) of the IPC; under Sections 25(1-B), (a), 26 and 35 of the Arms and Act; and under Section 17 of the CLA Act, pending in the court of learned Chief Judicial Magistrate, Latehar. 2. Learned counsel for the petitioner has submitted that the name of the petitioner comes on the basis of confessional statement of co-accused persons made before the police. Further no incriminating article has been recovered from the possession of the petitioner. He has not been put to TIP. 2026:JHHC:5669 Page | 2 3. Learned counsel for the petitioner has further submitted that other co-accused persons have been granted bail by co-ordinate Bench of this Court in B.A. No. 3404 of 2024; B.A. No. 3416 of 2024; B.A. No. 4941 of 2024; B.A. No. 3758 of 2024; B.A. No. 3616 of 2025; B.A. No. 9496 of 2025 and B.A. No. 9981 of 2025, copy thereof has been annexed as Annexure 2 series, and the case of the petitioner stands on better footing. 4. Therefore, claiming the ground of parity, submission has been made that the present petitioner may also be enlarged on bail. 5. Learned Additional Public Prosecutor appearing for the opposite party-State although has seriously opposed the prayer for grant of bail on the ground that against the present petitioner there are 13 criminal antecedents, in support thereof, the copy memo no. 224/2026 dated 28.01.2026 containing the description of criminal antecedents has been placed before the court. 6. Heard learned counsel for the parties. 7. This Court has posed a question to learned counsel for the petitioner that whether there were criminal antecedents against the co-accused persons also who have been granted bail, but, learned counsel for the petitioner failed to submit regarding criminal antecedents of co-accused persons and even in bail application there 2026:JHHC:5669 Page | 3 is no mention that the co-accused persons were having criminal antecedents. 8. The allegation against the petitioner is serious in nature alleging he is a member of extremist organization and similar nature of umpteen cases are pending, therefore, in such circumstances, the ground of parity would not apply in the case at hand, as such it would not be proper to release the petitioner on bail 10.
