By means of present writ petition, petitioner has sought the following relief:-
“Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 for expeditious disposal of pending complaint of petitioner dated 05.12.2023 (annexure no.2 at page no.26 to 29 to this writ petition), which is with respect to appropriate legal action against respondent no.6 in true and lateral spirit of Section 90(4) of the Uttarakhand Panchayat Raj Act, 2016 (as amended).”

Learned counsel for the petitioner submits that, despite the complaint submitted by the petitioner way back in the month of December 2023, respondent no. 2 has not taken any steps as mandated under Section 90(4) of the Uttarakhand Panchayat Raj Act, 2016 (as amended). He has confined his prayer to the extent that respondent no. 2 may be directed to decide the complaint of the petitioner dated 05.12.2023, annexed as annexure-
2026:UHC:3292 2 2 to the writ petition, within a stipulated time.

The prayer is quite innocuous which deserves acceptance.

Accordingly, writ petition is disposed of finally at the admission stage itself. Respondent no.2 is directed to decide the complaint of the petitioner dated 05.12.2023, annexure-2 to the writ petition, as expeditiously as possible, but not later than three months from the date of production of certified copy of this order, in accordance with law, after hearing all stakeholders in the matter.

Pending application, if any, stands disposed of accordingly.
